Agreeing to these terms
Using this site means you accept these terms. If you do not accept them, do not use the site. The site is operated by Botany Farms LLC ("we", "us", "our").
You confirm you are at least the age of majority in your state, and that you are of legal purchasing age for our products.
Orders and returns
Because the warehouse processes same-day, an order cannot be modified or canceled once placed. Review your order before you complete the purchase.
We are not currently accepting returns or refunds. If something is wrong with your order, email team@botanyfarms.com and we will help.
Your account
You are responsible for keeping your account and password confidential, for restricting access to your device, and for everything that happens under your account.
Using the site
You get a limited license to access the site for personal use. That does not include reselling or commercially using the site or its content, scraping product listings, pricing or descriptions, making derivative works, or copying information for a third party. Text, graphics, photos, logos and images may not be used without written permission.
- No illegal or unauthorised use of our products.
- No viruses, worms or destructive code.
- No harassment, impersonation, or obscene, defamatory or unlawful content.
- No commercial solicitation on the site.
Age verification
We are required by law to prevent sales below the legal purchasing age. Your name and address are used to confirm your identity and age, usually once. In some cases we may need additional information or a legible copy of your ID to complete an order, and we will cancel the order if it is not provided in reasonable time.
If a transaction is declined, contact team@botanyfarms.com before retrying — repeated attempts can place holds on your account.
Warranties and liability
The site, materials and products are provided "as is", without warranties of any kind to the fullest extent the law permits, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free.
We are not liable for direct, indirect, incidental, punitive or consequential damages arising from use of the site or our products. Some states do not allow these limitations, so parts may not apply to you.
Pricing errors and risk of loss
If a product is listed at an incorrect price we may refuse or cancel the order, even after confirmation and charge, and will credit the amount charged. All purchases are made under a shipment contract: risk of loss and title pass to you on delivery to the carrier.
Governing law
These terms are governed by the laws of the State of Minnesota, USA. Jurisdiction and venue sit with the state or federal courts in Hennepin County, Minnesota. Any claim relating to the site must be brought within one year of arising.
We may terminate these terms at any time. Provisions on copyright, trademark, disclaimers, limitation of liability and indemnification survive termination.
